Affton, Mo (KSDK) -- The public defender representing an Affton mother, who police said confessed to beating her son to death, filed a motion that the second-degree murder charge against Shelby Dasher be dismissed.
Police said Dasher confessed last November to hitting her 13-month-old son, Tyler, repeatedly because he would not stop crying and go back to sleep. They said she then dumped his body near the River Des Peres.
Shelby Dasher, 20, is in jail charged with second-degree murder.
Public defender Tara Crane says, "It's me protecting my client's due process rights and making sure that either a formal indictment is being returned against her or she needs to be released from custody."
If the public defender's request is denied, the defender is requesting the $500,000 cash-only bond be lowered.
