Granite City, Ill (KSDK) -- A former Granite City resident will spend the rest of his life in prison after receiving a new sentence for murdering a 60-year-old woman in 2006.
The Madison County State's Attorney's Office said Brian Gary pleaded guilty to the murder of Carol Newby, 60, on July 12, 2007 and was sentenced to 50 years in prison. He appealed it on the grounds that he should be classified as a habitual criminal and sentenced to life in prison.
Gary had two previous Class X felony convictions.
The Illinois Fifth District Appellate Court sent the case to Madison County and Gary was allowed to withdraw his original plea. Gary agreed to a stipulated bench trial where both parties agreed to the evidence. He was found guilty on September 26, 2012.
A retired police officer who was serving an eviction notice fond Newby dead in her home on January 13, 2006.
