ST. LOUIS COUNTY (KSDK) - A local mayor City Council members want to kick out of office is fighting back.
A hearing was held Thursday in an effort to prevent the impeachment of Ellisville mayor Adam Paul.
City Council members accuse him of overreaching his authority.
They had also accused him of drinking on the job. Paul took a polygraph test and the council members withdrew that allegation.
Paul's attorney says the city's charter is so vague and broad that the whole process is unconstitutional under Missouri law.
City Council members disagree and believe the charges will hold up during the impeachment trial that is scheduled to begin Monday. They also believe the charges will hold up at the state level if Paul files an appeal.
Paul believes the City Council is trying to oust him because he opposed tax breaks for a Walmart development in Ellisville.
The judge is expected to decide if the City Council can move forward with the impeachment process before the close of business on Friday.
